1. All of the plaintiff's claims are dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Details of the disposition;
A. The Plaintiff is a person who was appointed as a local rural community consultant on January 1, 2003, and was engaged in agricultural and rural community guidance services, such as agricultural expertise distribution, pesticide map control, etc. at the agricultural technology support team within the City Agricultural Technology Center.
B. 1) The Gangwon-do Personnel Committee on August 1, 2019 held on August 1, 2019 that the Plaintiff committed the following acts (hereinafter “instant misconduct”).
(B) On August 5, 2019, on the ground that the Local Public Officials Act violated Articles 48 (Duty of Fidelity), 49 (Duty of Good Faith), 51 (Duty of Good Faith and Impartiality), and 55 (Duty of Maintenance of Dignity) of the Local Public Officials Act, a resolution of removal from position was requested, and accordingly, the Defendant decided to remove the Plaintiff from position on August 5, 2019 (hereinafter “instant removal from position”).
(1) The Plaintiff refused to perform his/her duties as described in attached Table 1 from April 13, 2019 to July 4, 2019. ② The Plaintiff refused to comply with the civil petitioner’s justifiable request and refused to perform his/her duties, as described in attached Table 2 from April 24, 2019 to July 4, 2019, causing civil petitions. ③ The Plaintiff did not obey the direction of the superior with regard to his/her duties or business trips as described in attached Table 3 from May 8, 2019 to July 10, 2019. ④ The Plaintiff demanded that the Ordinance on the Performance of Official Duties of Agricultural Guidance was enacted or amended with respect to his/her duties, asserting that the date on which he/she was continuously imposed on him/her after April 13, 2019, ⑤ the Plaintiff was subject to a non-prosecution disposition with respect to the obstruction of performance of his/her duties as the Director of the Agricultural Technology Prosecutors’ Office having been demoted to the Director of the Agricultural Prosecutors’ Office 20.
(2) On September 2, 2019, the Plaintiff is subject to the Gangwon-do Review Committee.
