A Imprisonment with prison labor for a year and two months, and for a defendant B, for six months, respectively.
However, this judgment is delivered against Defendant B.
Reasons
Punishment of the crime
1. Defendants A conspired to forge the transaction specifications, receipts, etc. with Defendant B, who is an employee of the printing and reproduction company, for the purpose of deceiving the “E” bags as the store of satisfy, and to forge the said private documents.
around October 4, 2019, the Defendants: (a) provided the original specifications of transaction in the name of the E company and notified the revised matters, etc.; (b) Defendant B forged by means of preparing and printing the specifications of transaction in the name of the E company using the computer; (c) as described in the attached Table 1, the Defendants prepared 60 copies of transaction in the name of the E company, H department store, receipt in the name of H department store, and I department store; and (d) delivered the Defendant B a total of KRW 796,000 in the name of commission.
As a result, the Defendants forged the transaction statement in the name of E company, which is a private document related to a certificate of fact, H department store, and the receipt in the name of H department store.
2. Defendant A
A. On November 6, 2019, the defrauded posted a notice to the Defendant’s home located in Busan Jung-gu, Busan, stating that “I will sell E (E) bags” on the Internet, and made a false statement to the effect that I would deliver money to the victim D who contacted with the notice to the effect that I would transfer money.
However, in fact, the defendant did not have the intention or ability to sell the E refined bags.
As such, the Defendant, by deceiving the victim, transferred KRW 6,50,000 from the victim to the single bank account (L) under the name of the Defendant on the same day, and then delivered the victim with E as well, and as indicated in attached Table 2, the Defendant was the sales proceeds from four victims over four times in total as shown in attached Table 2.
