Reasons
1. Basic facts
A. As to the 40 square meters of multi-story house with a brick structure on the ground of 421 square meters in Incheon Cheongjin-gun, Incheon (hereinafter “D land”), the registration of the owner was completed in F in around 1950 on the building ledger, and the registration of the change of the owner’s name was completed in G on April 11, 2008, and the registration of the ownership preservation was completed in G on April 11, 2008.
B. On February 13, 2012, the registration of ownership transfer was completed on the ground of the sale on the same date in the Defendant’s future.
C. At the present time, the land owned by the Plaintiff was located on the ground of part 1,002.3 square meters of the C Forest land owned by the Plaintiff (hereinafter “instant forest”). On November 7, 2014, a building owned by the Defendant (hereinafter “instant existing building”) (hereinafter “instant forest”) is located on the ground that connects each point of KRW 15, 16, 17, 18, 19, 20, 20, 21, 22, and 15 in sequence, which is located on the land of KRW 15, 16, 18, 19, 19, 20, 20, 21, 22, and 15, indicated in the attached drawings.
In addition, the Defendant occupies the part (A) of the instant land (hereinafter “the part (a) of the instant land”) 389.5 square meters (hereinafter “389.5 square meters”) among the instant forest land, which are successively connected to each of the items in the same drawings, including 1,2,3,4,5,6,6,7,8,8,9, 10, 11, 12, 13, 14, and 7.
The registration of ownership transfer was completed in the first future on October 27, 1993, and on February 20, 2003, the registration of ownership transfer was completed due to the inheritance due to the agreement division as of October 26, 1994, and on April 19, 2013, the registration of ownership transfer was completed due to the sale as of April 8, 2013.
E. On September 1, 1988, the forest land of this case was transferred to L on August 31, 1988 due to sale and purchase, and on October 14, 1995, the forest land of this case was transferred to the Plaintiff on July 31, 1995.
