A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On August 28, 2015, the Defendant was sentenced to a suspended sentence of ten-month imprisonment with prison labor for night building intrusion larceny, etc. at the Seoul Central District Court on October 28, 2015, and the judgment became final and conclusive on September 5, 2015, and is currently under suspended sentence.

1. On March 14, 2016, the Defendant found one of the five mobilephones in Samsung Galthal ju, which is equivalent to KRW 900,00,00,00 in the market value where the victim C lost, on the road side where the victim C was unable to know whether it was once or less in Seo-gu, Seo-gu, Incheon.

The defendant did not follow necessary procedures such as returning the above mobile phone acquired as above to the victim and did so.

Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.

2. Accordingly, the defendant stolen the victim's property.

3. Violation of the Act on Financial Business Specializing in credit and fraud;

A. On April 20, 2016, the Defendant, at G convenience stores located in G convenience stores in Young-gu, Young-gu, Young-gu, Gyeonggi-gu, Gyeonggi-gu, Gyeonggi-do, presented the Agricultural Cooperative Card in F, which was stolen to the victim as if he had the right to use, as described in paragraph (2), and the Defendant was issued to the victim 8,600 won of typed tobacco and received a stolen card from the victim 2 A, and acquired the property by fraud.
