Punishment of the crime

Defendant A-Defendant A-State (hereinafter “H”) is a foreign company invested by Japan as a manufacturer of L CD glass plates within the I Corporation. 1. 피고인은 2015. 10. 2. 08:10경 구미시 K 소재 H(주) 정문 앞에서, 30여 명의 노조원들과 함께 집회를 하던 중 H(주) 영업이사의 차량이 회사 방면으로 진입하는 것을 발견하고 노조원들과 함께 달려가 위 차량을 에워쌌고, 이에 H(주) 경비원인 피해자 L(36세)가 노조원들에게 길을 열어줄 것을 요구하자 피해자에게 “개새끼야, 이런 병신 새끼들이 니네 집이나 지키지 왜 나와서 설치냐, 니가 뭔데 이 짓을 하고 있냐”라고 욕설을 하면서 양손으로 피해자의 멱살을 잡고 피해자의 우측 볼 부위에 불이 붙은 담배를 입에 물은 채로 갖다 대고, 멱살을 수회 흔들었다....
