A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
On April 30, 2012, the Defendant called the victim C to the end of the F.I.D., and said, “If a person makes a registration of incorporation among customers of the certified judicial scrivener office, who borrowed 50 million won with paid-in capital, he/she will refund the fees of 1.5 million won or less along with the principal for not more than 10 days.”
However, in fact, the defendant did not have any record of the above registration of incorporation at the time, and the defendant's work in his office for personal use such as repayment of debts due to gambling money was false as above, and since 380 million won or more without any particular property at the time, there was no intention or ability to repay the money even if he borrowed money from the victim.
The Defendant received KRW 50 million from the victim to the national bank account (number D) in the name of the Defendant on the same day, and received KRW 30 million in the above account on May 10, 2012, and KRW 50 million in the above account on May 18, 2012, respectively, and received KRW 130 million in total under the same name on the same day on May 18, 2012.
Accordingly, the defendant was given property by deceiving the victim.
