A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On April 3, 2016, the Defendant: “The 2016 Highest 6302, the Defendant called the victim B to deliver the uniforms to the victim B; “On the other hand, the Defendant was able to receive money for one week because he/she supplied the uniforms to the victim B, entered money after the initial delivery and draft, but he/she traded with the C Mart, so he/she is able to receive money for one week.

However, in fact, the Defendant did not intend to deliver the Maart uniform to C, and even if he received the uniform from the injured party, he thought that he would use it as a substitute for the repayment of approximately KRW 40 million to D’s personal debt, so the Defendant did not have any intention or ability to pay the price to the injured party within a week.

Nevertheless, on April 5, 2016, the Defendant: (a) by deceiving the victim as above; (b) obtained the delivery of the whole amount equivalent to KRW 26,210,00 in the market price of KRW 68kg from the nearby storage tank of Jindo-gun, Jindo-gun, Jindo-do; and (c) obtained the delivery of KRW 59,60,000 in total and KRW 1,668kg and KRW 9 million in cash from the above date to April 20, 2016 from the above date to the date of April 20, 2016.

The Defendant, on September 24, 2015, called "the 2016 Highest 7411, the Defendant," called "the victim F, who is an employee in charge of the customer of the Defendant’s working company, shall pay back the amount immediately if he/she lends 3 million won to the victim F, who is an employee in charge of the customer of the Defendant.

“A false representation was made.”

However, at the time of fact, the Defendant did not have any intent or ability to repay the debt, even if he borrowed money from the damaged person under the bad credit standing.

As such, the Defendant, by deceiving the victim, receives three million won from the victim to the Busan Bank account (G) in the name of the Defendant on the same day, and as indicated in the list of crimes in the attached Table from the time to October 10, 2015.
