Reasons
Punishment of the crime
【Defendant A, at around February 2014, posted a notice to sell “Adida S172” on the bulletin board of the NAV “N” (Cafe.naver.naver.com/Joint signature)” in the above residence.
However, the defendant did not have the above goods and did not have the intention or ability to send the goods even if he received money from the buyer.
Around February 14, 2014, the Defendant: (a) made a false statement that he/she would send 80,000 won to the victim E, who reported and contacted the above notice; (b) received 80,000 won from the victim to the Agricultural Cooperative (F) account in the name of the Defendant.
The Defendant, from that to March 23, 2014, received a total of KRW 990,000 from victims seven times in total, as shown in the attached Table 1, by means of the foregoing method, from the victims.
【Defendant A, on May 17, 2014, posted a false statement on the Internet’s website that “The Defendant would sell Gcont Performance Pet for KRW 170,000,” and sent money first to the victim H who had contacted and contacted with the Defendant at a non-place on the Internet, thereby making a false statement to the effect that the Defendant would give a ticket.
However, at the time of fact, the defendant did not have the relevant performance pocket, and even if he received money from the victim, he did not have the intention or ability to give the victim a performance pocket.
The Defendant, as such, by deceiving the victim and receiving KRW 170,00 from the Agricultural Cooperative account (F) in his own name, and by deceiving the victims over 20 times from around that time to December 9 of the same year, and received KRW 1,86,000 in total from the victims, as shown in the attached Table 2 of the Crimes List from around December of the same year.
