1. The Defendants shall share shares in the attached Form and each termination date sheet on the Plaintiff, among the 258 square meters in the Nancheon-gun N in Gangwon-do.
Reasons
1. Basic facts
A. P, which owned an O 2,457 square meters (hereinafter “Mamo-type land”) in Gangwon-do, which is the mother of the N 258 square meters in the Gangwon-do Incheon-gun N (hereinafter “instant land”), sold the said land to Qu, etc. after specifying the location, area, etc. of the said land from around 1962, and selling Q, etc. in installments, by specifying the location, area, etc. of the land purchased.
B. As above, since April 3, 1974, the land partitioned and sold was divided from the land cadastre, but the registration was made on April 16, 1993, and each owner who acquired a specific portion was registered as co-owner as to the land owned by himself and another person, not the sole owner of the land owned by himself.
C. As other land, the instant land, the partition registration of which was made from the land located at the mother on April 16, 1993, is also arranged in the form of co-ownership of shares, such as shares in the separate sheet and ownership shares in the termination date sheet, and the Plaintiff holding 156/4,914 shares, as in the form of co-ownership of shares.
R purchased 929 square meters from Q on May 11, 1967, including the part of the instant land, among the land which was gathered from Q Q, but it was revealed that part of the Plaintiff’s church building constructed on the land of Incheon-gun, Gangwon-do, which was adjacent to the instant land, was invaded by the instant land. After purchasing 78 square meters from R on March 25, 1975, T which was a church, was donated to the Plaintiff on February 10, 1978 through the form of co-ownership transfer.
E. The Plaintiff independently uses the instant land as a site for church buildings and churches, along with the Gangwon-do Incheon-gun S, which previously owned the instant land.
F. As above, the specific part of the land gathered from P, Q, etc. was purchased and occupied and used.
