A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On December 8, 2015, the Defendant made a false statement to the effect that “D” company dormitories in Ulsan-gu, Ulsan-gu, 305 Dong 1104, the Defendant paid the victim E with interest at monthly pay in the face of the week, and the father would pay the principal when resolving this case.”
However, the Defendant’s parent did not have been able to repay his/her debt while operating his/her business. At that time, the Defendant had been unable to obtain a loan under the Defendant’s name because the Defendant had been unable to do so, such as 20 million won, and the Defendant had no intention or ability to repay his/her debt even if he/she borrowed money from the damaged party, on the ground that he/she was willing to obtain a loan by making the Defendant joint and several surety or consume the money from the damaged party.
The Defendant deceptions the victim as above, and caused the victim to stand a joint and several surety from the “(State) Loan (name after Daehan: MS A’s loan)” on the same day, and caused the victim to stand a joint and several surety by the same method, including inducing the victim to stand a joint and several surety. From then to December 9, 2015, the Defendant was granted a loan of KRW 40 million in total over eight times, as described in subparagraphs 1 through 8 of the attached List of Crimes (1) of the attached Table, from around December 10, 2015 to March 16, 2016, from around 13 times in total, as described in subparagraphs 9 through 21 of the attached Table of Crimes (1) of the attached Table of Crimes (1) to (1) to 213 times in total.
Accordingly, the defendant, by deceiving the victim, acquired the total amount of 83,80,000 won property or property benefits.
