A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

[criminal history] The defendant was sentenced to a suspended sentence of two years for a crime of violation of road traffic law at the Jeonju District Court on September 24, 2009. On July 13, 2007, the Jeonju District Court issued a summary order of KRW 1.5 million for the above crime.

[Criminal facts]

1. The Defendant is a person who is engaged in driving of the B Twork XG car in violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Bodily Injury resulting from dangerous driving).

On December 25, 2016, the Defendant driven the foregoing vehicle under the influence of alcohol level of 0.152% among blood transfusions on December 25, 2016, and changed the lane into one lane while driving the vehicle along the two-lanes of the two-lane road in front of the building Seo-gu, Seoan-gu, Incheon.

In such cases, a person engaged in driving of a motor vehicle has a duty of care to check the flow of the vehicle in the lane that he/she intends to change the course, and to prevent the accident in advance by changing the lane safely, such as making it possible to see the left and right well.

2.
