1. Defendant A, B, and C’s status is the head of the organization division of the H Trade Union; Defendant B is the head of the organization division of the H Trade Union; Defendant C was the head of the H Trade Union’s organization division; Defendant C was the head of the H Trade Union’s special committee on layoff of Hno-I branch from November 2009 to December 2010.
2. On November 17, 2010, from November 18, 2010 to November 18, 2010, H-trade union organized an “a concentrating strike at the first and second place of business,” during which members of the Ha branch, J branch, K branch, L branch, and M branch participate.
Accordingly, since November 17, 2010, 11:15 on November 17, 2010, 50 members of I branch, approximately 40 members of J branch, approximately 20 members of K branch, and approximately 80 members of M branch were on board in tourism buses, etc., and held assemblies such as street publicity, etc. at the location of the government central office.
3. Facts charged;
A. No person who violates the Assembly and Demonstration Act by Defendant A and B shall hold any outdoor assembly or demonstration in a place within 100 meters from the boundary of the office building or dwelling of diplomatic missions of any foreign diplomatic office or residences of any foreign diplomatic mission located in the Republic of Korea.
Nevertheless, from November 18, 2010 to 11:30 of the same day from around 10:0 on the same day, the Defendants: (a) opened a relief in front of the Madi Building with approximately 70 meters away from the boundary point of the office building of the French Embassy in Seodaemun-gu Seoul, Seoul to approximately 30 meters away from the boundary point of the office building of the French Embassy in Korea; (b) Defendant A, along with approximately 120 members of the HF and the police requesting voluntary dispersion, “When the police attempted to arrest, they are frightd.e., the police dogs; (c) f.e., the police dogs; (d) f., f., f., f., f., f., f., f., f., f., f., f., f.,” and Defendant B kept at the scene.
