1. The instant lawsuit shall be dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. We examine ex officio the lawfulness of the instant lawsuit.
The purpose of the claim in civil procedure must be clearly identified so that the content and scope can be clearly identified, and the issue of the purport of the claim is the matter to be examined ex officio. Thus, where the purport of the claim is not specified, the court shall order ex officio correction and dismiss the lawsuit if it does not comply with the order
(See Supreme Court Decision 201Da111459 Decided March 13, 2014). The instant lawsuit is sought against the Defendants to implement the procedure for the registration of ownership transfer based on the mutual title trust termination with respect to each share out of 4,797 square meters in the ship stated in the purport of the claim against the Defendants. The instant lawsuit was filed by the Plaintiff. The instant court submitted to the Plaintiff materials by which the title holder of the instant forest and field and the Defendants could have known the inheritance relationship. The instant lawsuit was filed several times with the Defendants’ correction orders to specify the purport of the instant lawsuit in accordance with their respective ownership share in the instant forest and field. However, the Plaintiff did not comply
Therefore, the instant lawsuit is unlawful because it does not specify the purport of the claim.
2. In conclusion, the lawsuit of this case is unlawful and dismissed, and it is so decided as per Disposition.
