1. Defendant A shall be punished by imprisonment for three years;

Punishment of the crime

From December 26, 2014 (the beginning date of the year of donation establishment), the E cooperative is a corporation that runs the business of developing and selling health and food in the second floor of the Gangnam-gu Seoul Metropolitan Government MM building (the third floor of the building in Gangnam-gu, Seoul), and Defendant A, from the end of November 2014, has been working as the head of the above E cooperative and has been in charge of managing and supervising the overall operation of the cooperative, and provided explanation of the products and business against its members. From around December 8, 2014 to February 4, 2015, while serving as an educational director and a general director for early March 2015, Defendant D produced PPT data to explain the position structure of the above E cooperative and explained marketing data to its members. Defendant D was in office as a management director of the said E cooperative from December 8, 2014 to February 4, 2015, and made an application for membership and a marketing material for the business explanation session, and made an application for membership and a marketing material for the said E cooperative’s organization and business contents against its members.
