The plaintiff's claim is dismissed.
Litigation costs shall be borne by the plaintiff.
Reasons
1. Facts of recognition;
A. 1) The Plaintiff is a C apartment (hereinafter “instant apartment”).
() The council of occupants’ representatives and the insured period from December 22, 2017 to December 22, 2018, and the amount of insurance coverage is 83,410,964,150 won (building) and the comprehensive insurance contract for high-quality apartments (hereinafter “instant insurance contract”).
2) The Defendant manufactured and sold air conditioners (a model name: E, manufacturing in 2006; hereinafter “instant air conditioners”) installed in the instant apartment unit D, as a company engaging in manufacturing and selling electronic machinery and tools.
B. (1) On August 12, 2018, around 12:25, 2018, a fire occurred in the air-conditioning room in the instant air-conditioning room located in Vietnam, which is adjacent to the instant apartment building D, and the inside of the air-conditioning room and the air-conditioning room and the outer wall of the instant apartment. A fire occurred during the process of extinguishing fire, and the inner floor, the ceiling and the walls of the relevant apartment are flooded by fire water (hereinafter “the instant fire”).
(2) Under the instant insurance contract, the Plaintiff paid KRW 14,472,276 in total, KRW 14,472,276 in the council of occupants’ representatives on June 24, 2019, KRW 25,186,135 on June 24, 2019, KRW 7,296, KRW 066 in total, KRW 7,066 in December 26, 2018, KRW 7,176 in April 30, 2019, and KRW 1,472,922 in relation to the damages to common areas of the instant apartment.
C. 1) According to the results of the fire site inspection of the Suwon Fire Station, there was no special heat source other than the air conditioner of this case, and the outdoor electric power source line was connected to the lower part of the wall surface of the outdoor air unit, and electric melting tracess (this is distinguishable, the left wall of the upper part is considerably damaged than the right wall and the whiteization phenomenon is distinctive, and electric meltings for the reason that cannot be seen from the air conditioner connecting the outdoor air line which was operated recently at all times.
