1. The plaintiff's claim is dismissed.

1. Facts of recognition;

A. On October 1, 2015, the Plaintiff entered into a contract for a fire-fighting mutual aid of apartment organizations (hereinafter “instant mutual aid contract”) with C apartment unit council of occupants, including the period of mutual aid between 16:0 and 16:00 (12 months) on October 1, 2016, the amount of mutual aid subscription, and KRW 57,027,530,000 on the amount of mutual aid.

B. The Defendant manufactured and sold air conditioners (a model name: E; hereinafter “instant air conditioners”) installed and used by D residing in C Apartment as a company aimed at manufacturing and selling electrical machinery, apparatus, related equipment, and their parts.

C. On August 4, 2016, around 19:30, a fire occurred in the beta zone abutting on the inside bank of the Jung-gu, Jung-gu, Seoul apartment F (hereinafter “instant apartment”) where D is residing, and there was a small loss of, or inundation of, the inner finishing materials inside the inner bank, and some of the household tools were damaged, polluted, or flooded.

At the time of the fire of this case, the air conditioner of this case was installed in Vietnam, and the air conditioner of this case was discovered in the outer electric power source line.
