A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
1. On July 19, 2013, the Defendant: (a) in collusion with Nonindicted Land and Housing Corporation (hereinafter “LH Corporation”) in order with Nonindicted Party C (hereinafter “LH Corporation”) was entitled to receive compensation from LH Corporation, using the fact that it was registered as the relative of a grave located in the project area in Pyeongtaek-si area in connection with the housing site development project for the ancient International City, and obtained permission for relocation; (b) excavated another’s grave; (c) buried the remains; and (d) excavated the remains of the deceased in his/her name and buried the remains in his/her grave in his/her name in his/her name; and (d) buried the remains in another’s grave in his/her name and buried them in his/her grave in his/her name in his/her name in his/her name in his/her name in his/her name on the same day as the date when the remains were removed; and (d) excavated the remains in his/her body in his/her name in his/her name in his/her name in his/her name.
2. On July 19, 2013, the Defendant continued to violate the Act on the Acquisition of Land, etc. for Public Works and the Compensation Therefor, in collusion with C, submitted to the staff in charge of the victim the relevant documents, such as an application for compensation for relocation of a grave, which was falsely prepared in collusion with C, as if he/she was the genuine manager of the five-year period of the grave excavated without permission, such as the said paragraph (1). On August 7, 2013, the Defendant received KRW 15,983,500 from the victim by receiving KRW 15,983,50 as the compensation for five-year relocation of the said grave from the new bank account under the name of the Defendant, and received the said KRW 15,983,500, and received the compensation by fraud or other improper means.
