Defendants shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
The Defendants, using the fact that the Korea Land and Housing Corporation (hereinafter referred to as the “LH Corporation”) registered as a relative of a grave located in the project area in connection with the development of the land for a ancient-line international city in Pyeongtaek-si, and obtained permission for relocation, were able to receive compensation from the LH Corporation, and found another person’s grave and bury the remains thereof and claim a false compensation.
1. Defendant A
A. A. Around March 31, 2013, the Defendant: (a) removed the remains of each of the above graves using a spacule without any authority to manage and dispose of the two graves (ever 70,74) of the deceased and wounded in Pyeongtaek-si D; (b) removed the remains in the said grave; and (c) buried the said remains in the F crematorium located in Dong-gu, Dongnam-gu, Chungcheongnam-gu, Seoul; and (d) buried the remains in the said cremation.
(2) On April 21, 2013, the Defendant: (a) removed the remains of the said graves from the spawn using the spawn, without any authority to manage and dispose of them; (b) removed the remains of the said graves from the spawn; and (c) laid the remains in the said cremation; (d) buried the said remains in the said crematorium and laid the remains in the spawn.
Accordingly, the defendant found five graves and damaged five remains of the deceased in that area.
B. On April 1, 2013, the Defendant violated the Act on the Acquisition of Land, etc. for Public Works and the Compensation Therefor (1) at the victim LH Corporation office located in Pyeongtaek-si, Sejong-si, and the Defendant completed the said office.
(1) As described in paragraph (1) of this Article, an application for compensation for the relocation of a grave and other related documents prepared with false statements as if the said person were the true manager of the two graves excavated without permission, shall be submitted to the staff in charge of the victim, and the remaining person shall be the two-term compensation for the relocation of the said grave from April 10, 2013 to the new bank account under the name of the defendant
