A shall be punished by imprisonment with prison labor for each of the crimes of "2018 Highest 539" cases and "2018 Highest 5305" cases.
Reasons
Punishment of the crime
On December 18, 2013, the Defendant was sentenced to six months of imprisonment with prison labor at the Seoul Eastern District Court for fraud, etc. on January 27, 2014; on January 13, 2015, the Seoul detention center completed the execution of the sentence; on January 13, 2015, the Defendant was sentenced to eight months of imprisonment with prison labor for a violation of the Attorney-at-Law Act at the branch court of the Daegu District Court.
【Criminal Facts】
The Defendant received a loan from D, E, etc. under the name of the “Spool (title provider)” and purchased the vehicle, and sold it immediately, and made and distributed the “Spool” by means of the prompt sale. The Defendant did not have any intent or ability to pay installments properly even if he/she received a loan from a financial company.
Accordingly, D was willing to take advantage of the nominal provider, which is the name of the nominal provider, forged the certificate of employment of the nominal provider, and the defendant created a vehicle abandonment letter, etc. necessary for distributing the large-scale vehicle, and E was recruited to take charge of providing only the vehicle purchased by the nominal provider in the document form, while selling and selling the large-scale vehicle inside the G located inside the city of Ansan-si, Ansan-si, by taking charge of providing only the vehicle purchased by the nominal provider as a document.
