A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The defendant is not a person handling narcotics.
1. On January 15, 2014, at around 13:17, the Defendant: (a) reported an Internet advertisement that sells psychotropic drugs-related psychotropic drugs-related Mesofts (i.e., one philopon; hereinafter “philopon”); and (b) decided to contact B with one Melopon to purchase Melopon; and (c) remitted KRW 400,000 to the Daegu Bank Account in the name of C known to B.
From 15:00 on January 15, 2014 to 18:00, the Defendant purchased a penphone in a manner that would bring about approximately 0.4g of the penphone, which B concealed in the D market near Incheon Gyeyang-gu.
2. The Defendant affixes his/her seal from around 18:00 on January 15, 201 to the following:
1. From 03:00 to 03:00, the Defendant’s house in Gyeyang-gu, Incheon, administered philophones purchased at the Defendant’s house with the same paragraph as paragraph 1, in a way of injecting them into the Defendant’s arms three times.
3. On January 18, 2014, at around 14:15, the Defendant decided to purchase the re-written phone from the above B, and remitted KRW 800,000 to the Daegu Bank Account in the name of C designated by B.
From 16:00 on January 18, 2014 to 18:00, the Defendant purchased penphones by means of bringing about approximately 0.8g of philopon, which B hidden in the D market near Incheon Gyeyang-gu, in its postal box.
4. The Defendant affixes his/her seal from around 18:00 on January 18, 2014 to the following:
1. From 06:00 to 06:00, the Defendant’s house in Gyeyang-gu, Incheon, administered philophones purchased at the Defendant’s house with paragraph 3, by means of injecting the Defendant’s arms for four occasions.
5. On February 25, 2014, the Defendant decided to purchase the re-written phone from the above B around 15:23, and remitted KRW 400,000 to the new bank account in the name of E, a stock company designated by B.
From February 25, 2014 to around 17:00, the Defendant brought about approximately 0.4g of philopon, which B concealed in its postal box, from the building near the Gyeong River Station in Incheon Gyeyang-gu.
