1. Plaintiff (Counterclaim Defendant) who exceeds the following portions among the parts concerning the principal lawsuit of the judgment of the first instance.

1. Facts of recognition;

A. The Plaintiff is an insurer who concluded an insurance contract with respect to B Oralba (hereinafter “the instant Oba”), with the insurance period from November 30, 2009 to November 30, 2010 (hereinafter “the instant insurance contract”).

The content of the insurance contract is one personal compensation (the amount set by the enforcement decree of the law) and 10 million won.

나. C, 망 D, E, F는 각자 오토바이를 운전하여 놀러 가기로 하였는데, 2010. 7. 4. 03:50경 남양주시 별내면 화접리 178 철길 앞 별내 택지지구 아파트 공사 중인 편도2차선 도로를 E과 F가 앞서 가고, 망 D은 그 뒤를 G 오토바이를 운전하여 1차로를 따라 갔으며, C는 다시 망 D의 뒤에서 시속 약 90km의 속력으로 2차로를 따라 이 사건 오토바이를 운전하여 진행하던 중, 급하게 좌로 굽은 도로(이하, ‘이 사건 사고장소’라고 한다) 부분에 이르러 망 D은 제대로 오토바이의 방향을 틀지 못하고 1차로에서 2차로를 가로질러 넘어오면서 길가에 설치된 플라스틱 방호울타리를 충격하여 위 오토바이는 좌측으로 넘어지고 망 D은 2차로로 튕겨 나와 쓰러지는 사고가 발생하였다

한편 C는 망 D의 약 20m 뒤에서 이 사건 사고장소 2차로를 따라 진행하던 중, 위 선행사고로 튕겨 나와 쓰러진 망 D 앞에 미처 제동하지 못하고 망 D을 지나치면서(망 D을 충격하였는지 여부는 아래에서 살펴본다) 오토바이가 들려서 날아가고, C는 중심을 잃고 쓰러지는 사고가 발생하였다
