Defendant
A, B, and C shall be punished by imprisonment with prison labor for six months, and by imprisonment with prison labor for five months.
provided that this ruling has become final and conclusive.
Reasons
Punishment of the crime
1. Defendant A’s duties are those who were in charge of the position of the president of the F organization racing branch from April 29, 2005 to March 15, 201; Defendant B is in charge of the position of the president of the G organization racing branch from May 1, 1997 to the present date; Defendant C is in charge of the position of the president of the H organization racing branch from January 1, 1995 to the present date; Defendant D is in charge of the position of the president of the H organization racing branch from March 16, 201 to March 16, 201.
As the president of the above three organizations, the Defendants have duties to execute the budget of each organization in order to promote the welfare of its members while managing the subsidies (as approximately KRW 17 million) paid to each organization from the racing-si each year and the profits from the operation of the veterans hall (as approximately KRW 12 million).
2. Defendant A
A. On January 15, 2007, the Defendant embezzled KRW 10,75,80,00 in total for personal purposes, including withdrawing KRW 69,00 from the subsidy management account and using it for personal purposes, from March 15, 2011, by using KRW 172 times in total for personal purposes, including KRW 10,75,80 in total for 172 times as indicated in Table I-1, and for personal purposes, 10,75,800 while on duty, for the members of the said organization.
B. On June 21, 2007, the Defendant was provided with KRW 1,320,00 in the office of the F organization racing conference located in I of the Republic of Korea on the following occasions: (a) even though the Defendant was provided with KRW 1,50,00 in the name of vehicle support expenses from the Korea Institute of Native Energy, the Korea Institute of Native Energy, in connection with the participation of the National Cemetery, from that time by withdrawing KRW 1,50,000 from the subsidy management account of the said organization for personal purposes and using it for various public charges from that time by means of double disbursement, etc. of various public charges from September 16, 2010 to that of September 16, 2010.
