Defendant shall be punished by a fine of one million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

On September 23, 2015, the Defendant was sentenced to a two-year suspended sentence for the crime of rape by the Incheon District Court, and the judgment on October 1, 2015 became final and conclusive.

In collusion with C, although the Defendant did not possess the pertinent goods and did not intend to acquire them and deliver them otherwise, the Defendant intended to commit a crime of street gathering by receiving all or part of the price of the goods in advance from the applicants who wish to purchase the used goods, which was contacted through the Internet “NAV Roster,” etc., a trading site of used goods.

Accordingly, on April 24, 2014, at around 09:28, the Defendant made a false statement with C to the effect that “If 260,000 won is transferred to a bank account in the name of A, she will send gallon 21 unit in galthot to the Korean bank account.”

As above, the Defendant, in collusion with C, by deceiving the victim, received KRW 260,00 from the victim to the above bank account as the price for the goods on the same day, and received KRW 260,00 from the victim as the price for the goods on the same day, and received KRW 4,465,00 in total from 15 times as indicated in the attached list of crimes by pretending to sell and deliver the goods which were not held from April 21, 2014 to May 8, 2014.

Accordingly, the defendant conspireds with C to acquire the victims' property.
