Defendant
C Co., Ltd. (Representative E) was a corporation established for the purpose of manufacturing automobile-resistant parts, etc. in the Gu and USF, and was in progress in the construction of a new factory in the Gu and US G and H.
Defendant
A is the chief of the general affairs of the above company, and the defendant B is a heavy equipment engineer who drives Poke equipment, etc.
1. Defendant A and Defendant B
(a) A person who intends to divert a mountainous district shall obtain permission from the head of the relevant forest agency, etc. for a specified purpose;
Nevertheless, the Defendants conspired to acquire earth and sand collected in the course of the work instead of the Defendant B’s construction of factory site, such as flat work, in the above land.
Accordingly, the Defendants did not obtain permission from the head of the forest office, etc. on December 3, 2016, and performed the mination of land by cutting off and raising land with heavy equipment such as pokes, etc. in the mountainous districts of approximately 2,979 square meters in the Gu-si G G-si, Gu-si, Seoul, and the same around December 3, 2016.
As a result, the Defendants conspired to divert the mountainous district without permission from the head of the forest.
(b) A person who intends to temporarily use a mountainous district shall report to the head of the forest office;
Nevertheless, on December 3, 2016, the Defendants did not report to the head of the forest office, etc., and kept a closed tree in the mountainous district of approximately 4,435 square meters in the Gu-U.S. 1 Japanese-si, Seoul, and used the same mountainous district as a work for passage of heavy equipment, such as truck and pokes.
As a result, the Defendants conspired to temporarily use the mountainous district without reporting to the head of the forest office.
2. Defendant C Co., Ltd. committed the above violation in relation to the Defendant’s business at the above date, time, and place.
