[Reasons for Recognition] Facts without dispute, Gap 1, 2, 9, 12 evidence, Eul 2 and 3 evidence (including the number with each number), the purport of the whole pleadings
B. According to the facts of recognition of liability for damages and 1) the occurrence of liability for damages, the Defendant, a mutual aid business entity, is liable to compensate the Plaintiffs, who are their successors, for the damages incurred by the Deceased due to the operation of the Defendant’s vehicle, barring special circumstances.
B. At the time of the instant accident, the Defendant, as the driver of the Defendant’s vehicle, was unable to predict that there was a pedestrian who violated the signal at the place where the instant accident occurred, and even if the deceased was stopped at the time of discovery, it was difficult to avoid the accident. Thus, the Defendant asserted that there was no fault on the driver of the Defendant’s vehicle.
The location of the instant accident was a place where there was no obstacle to verifying the bank by the crosswalk between the traffic islands; there was a neighboring commercial building; it was possible to expect pedestrians who want to cross the road because the section between the traffic islands and the traffic islands was narrow; and the victim immediately before the accident stops the crosswalk.
