Defendant

A is the representative director of the Dispute Settlement Bank D, who is an air temperature damper, air-conditioningr production, and installation company in Bupyeong-gu Incheon Metropolitan City P Building B, and Defendant B is a public official of Grade VII belonging to Incheon Metropolitan City who works in Q of Incheon Metropolitan City from August 25, 2011 to December 31, 2014, and is in charge of the purchase of machinery and equipment to be installed in the RF stadium, Defendant C is a person working in the Dispute Settlement Bank D from October 14, 2009 to October 15, 201, and Defendant C is a corporation established for the purpose of producing and installing air-conditioning, air-conditioningr, air-conditioningr production, and installation.

1. In order to support the development of new technology and new products for small and medium enterprises with high risk of import substitution and export extension, Defendants A and C promoted “S” for at least 10 full-time employees, and subsidized the designated companies with government contributions.

around May 2010, the Defendants: (a) there was no entitlement to file an application for the aforesaid “S” due to the full-time employees of the Dispute Resolution Co., Ltd.; (b) Defendant C prepared a business plan to receive the said “S” subsidy by compensating the personnel expenses and development expenses; and (c) the Defendants conspired to use the subsidies in installments.

around May 31, 2010, the Defendants: (a) purchased various development equipment from July 1, 2010 to June 30, 2012; (b) employed six new researchers to participate in the performance of the task; and (c) participate in five existing human resources (A, C, T, U, andV) at 74-50% in the performance of the task; and (d) submitted a plan to perform the “W” task worth KRW 923 million in total; (b) submitted a plan to perform the project plan to support the government contributions of KRW 600 million to the Incheon Regional Small and Medium Enterprise Office; and (c) after deliberation by the Korea Industrial Technology Evaluation Institute, the Defendants submitted a project plan to develop technological innovation of small and medium enterprises, stating that the government contributions will be subsidized KRW 600 million in total.
