The prosecution of this case is dismissed.
Reasons
At around 22:20 on December 11, 2019, the Defendant committed assault on the part of the victim's left part of the kniveter with a knive hand, which was flicked to the victim C (the 44 years of age).
2. The offense of assault can not be prosecuted against the victim’s express intent (Article 260(3) of the Criminal Act). Since the victim expressed his/her intention not to prosecute the defendant after instituting the prosecution, the prosecution of this case is dismissed in accordance with Article 327 subparag. 6 of the Criminal Procedure Act.
