Defendants are not guilty.

1. On December 21, 2009, the Defendants were awarded a successful bid for the factory site and part of the factory property, etc. located in Chungcheongnam-gun, Chungcheongnam-do, where the victim D corporation owned by the victim D corporation. In the above factory inside the factory, the Defendants kept goods worth KRW 162,148,40 in total of 117 item market prices, including stand-type air conditioners that the Defendants did not receive a successful bid.

Accordingly, on March 2010, F, the representative director of the victim company, who moved to drive one motor vehicle for the victim company's employees G in order to recover the above water, but he did not recover the goods at the request of the Defendants, and left the said motor vehicle for the victim company, without obtaining a written confirmation to the effect that all the goods were received.

On March 30, 2010, the above F came to know that the Defendants were arbitrarily using the said vehicle without permission and demanded the Defendants to return the said vehicle. However, the Defendants refused to return the vehicle without justifiable grounds and refused to return it.

In this way, the Defendants conspired to embezzlement the amount equivalent to 15 million won at the market price of one vehicle owned by the victim company.

2. According to the records, including the witness I's legal statement, the suspect interrogation protocol of the prosecution against the Defendants, F, and J's prosecutor's statement, investigation report (G statement hearing report) and investigation report on behalf of the Defendants, on December 21, 2009, on behalf of the victims of E, on behalf of the victims and their spouse, I was awarded a joint bid for factory sites and some factory assets, etc., which were owned by E, and thereafter has overall control over factory management and semiconductor packaging industry. In the process, I have problems such as the type, quantity, and return of the goods excluded from the above auction such as the representative F, etc. of the victim company.
