1. The plaintiff's claim is dismissed.

1. The following facts do not conflict between the parties, or may be recognized by comprehensively taking account of the overall purport of the pleadings in each entry in Gap evidence Nos. 1-9, 15, and Eul evidence Nos. 9 and 10.

On March 15, 2015, Seo-gu Incheon Metropolitan City announced a public announcement of the repair and maintenance of individual measuring equipment (service period from April 2015 to December 31, 2015; hereinafter “instant service”) of the food-based measurement equipment (hereinafter “instant service”) on March 15, 2015, and made a public announcement of re-tender on March 27, 2015 and April 3, 2015.

B. On May 18, 2015, the Plaintiff participated in the bid price of KRW 88,232,800, and was selected as the first successful bidder as a result of opening the bid on April 9, 2015. On May 18, 2015, the Plaintiff entered into a contract with Seo-gu Incheon Metropolitan City to perform the instant service from May 19, 2015 to December 31, 2015 (hereinafter “instant service contract”). Accordingly, the Plaintiff submitted the starting system of the instant service to Seo-gu Incheon Metropolitan City on May 19, 2015.

The maintenance and repair company: the purpose of this Convention is to facilitate the supply of goods or the provision of technical assistance to the new mining engineering entity with respect to the maintenance and repair services of the individual measurement system of food waste in the Seo-gu Incheon Metropolitan City ( technology recognizing original information through Rodi-Frequcy Id, and radio waves) by RFD (RD) in Seo-gu, Seo-gu, Incheon Metropolitan City.

Article 2 (Scope of Use and Convention) (1) The Convention shall restrict the scope of use only for the supply of goods or technical assistance to the above project.

(2) The scope of technical assistance to be provided by a manufacturer or supplier to a new optical engineering among the above goods shall be as follows:
