The defendant's appeal is dismissed.
Reasons
1. Summary of grounds for appeal;
A. The Defendant was aware of the fact that he was operating a travelr E in the Chinese Cheongdo, through a leaflet, and the fact that he requested E to issue a domestic visa and paid 8,500,000 won in the price. However, it was impossible to find out the circumstance that E forged and exercises a document in order to issue a F-4 qualification visa that the Defendant could not have been issued.
Nevertheless, the judgment of the court below that found the Defendant guilty of the facts charged of this case is erroneous and adversely affected by the judgment.
B. The sentence of a fine of three million won imposed by the court below on the defendant is too unreasonable.
2. Determination on the grounds for appeal
A. The defendant's assertion of mistake of facts in the court below made the same assertion as the grounds for appeal in this part, and the court below rejected the above argument by explaining the judgment on the defendant's argument. The court below's decision is just and acceptable if we compare the above judgment of the court below with the records.
In addition, various circumstances recognized by the court below based on evidence duly adopted and examined by the court below, i.e., ① a person with F-4 qualification is not able to work for a daily labor worker (a simple labor activity, etc.), but it is true that the defendant works for a daily labor worker according to the necessity for reasons such as circumstances where it is difficult to detect such violation in reality, and the defendant also has been engaged in daily labor work in this court, ② the defendant's defendant's father as recognized by the defendant himself was staying in Korea as F-4 qualification visa, ③ the defendant was aware that he was a F-4 visa only after entering Korea around May 201, but it does not seem that he followed the procedure to change or re-issue the visa issued by mistake, and ④ the defendant was issued a non-person with H-2 qualification visa, and the degree of KRW 5 million is 5 million.
