A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Even if the Defendant is not a person handling narcotics, the Defendant dealt with the Metropha (the continuous philopon; hereinafter referred to as the “philopon”) as follows:

On October 2012, the Defendant discovered 0.4g of philophones from a box for storage of philophones (A. 0.15g) at a scopon in the store located in Seongbuk-gu Seoul, Seongbuk-gu. On October 31, 2012, the Defendant kept approximately 0.25g of the above philoopon in the Gro vehicle parked in the front of the Seongbuk-gu Seoul, Seongbuk-gu, Seoul, while displaying about 0.25g of the above philoopon in the Gro vehicle located in the F, which is located in the front of the Seongbuk-gu, Seongbuk-gu, Seoul, and asked “Wloopphones” as it is, and around that time, the Defendant scopon’s meines, and consumed them on two phiopons (A. 0.1g.) over two occasions at the scopon site and then stored on three occasions at the scopon.

Accordingly, the Defendant administered philophones.

1. Article 62 (1) of the Criminal Act: Suspension of execution (the fact that there is no same attached power, reflect, etc.);

1. Probation and community service order under Article 62-2 of the Criminal Act;

1. The proviso to Article 67 of the Narcotics Control Act;

1. It is so decided as per Disposition for not less than Article 334(1) of the Criminal Procedure Act.
