A defendant shall be punished by imprisonment for six months.

Punishment of the crime

On July 9, 2015, the Defendant posted an article to the effect that he/she would sell the Internet Game money “E” on the bulletin board at “C”, the Internet NVber C, and the Defendant posted a false statement to the effect that he/she would sell the Internet Game money, and that he/she would sell the said article to the victim D who contacted with the Defendant’s mobile phone number at KRW 95,00.”

However, the defendant did not have intention or ability to sell game money to the victim.

The Defendant, by deceiving the victim as such, was remitted KRW 95,00 to an enterprise bank account in the name of the Defendant as the sales proceeds of game money from the victim.

In addition, the Defendant received total of KRW 2,191,80 from 15 victims, as indicated in the list of offenses, from around the above day to November 1, 2015.

1. On November 13, 2015, the Defendant: (a) connected a computer to “Ekbook”, which is a NAV Internet game transaction site; and (b) contacted the victim FF, who posted a notice of “purchase of game money” to Kakao Stockholm; and (c) made a false statement that “I would sell game money if first deposit is made.”

However, even if the defendant received the payment from the injured party, he did not have the intention or ability to sell the game machine.

Nevertheless, the defendant deceivings the victim as above and received 1.60,000 won from the victim's bank account under the name of the defendant.

2. On November 14, 2015, the Defendant visited “G” by means of a computer at a scarkao site where a place was not located, and then called “purchase of game money” with the victim H who posted the article, called “to sell game money if the first deposit is made.”

However, even if the defendant receives the payment from the injured party, he wishes to sell the game money.
