Punishment of the crime

[2018 Highest 1510] On February 8, 2018, the Defendant posted a computer monitor sales report on the Internet website, and reported it to the victim B who contacted with the Defendant. However, in fact, the Defendant did not have the above monitor and was planned to use it for the purpose of illegal sports gambling funds even if the Defendant received the sales proceeds from the victim, and thus did not have the intent or ability to send the monitor to the victim.

As above, the Defendant deceiving the victim and received KRW 125,00 as the sales proceeds from the post office account in the name of the Defendant on the same day. From February 7, 2018 to March 6, 2018, the Defendant deceptioned the victims, as stated in the attached crime list, and received a total of KRW 835,000 on five occasions in total.

1. On March 8, 2018, around March 2018, the Defendant, at the Defendant’s home located in Gwangju Northern-gu, posted a computer monitor sales report on the Internet website at the Defendant’s home located in Gwangju Northern-gu, and reported this fact to the effect that “the Defendant would send a monitor when paying the sales proceeds.” However, the Defendant did not have the above monitor, and even if having received the sales proceeds from the injured party, was planned to use it for the purpose of illegal sports gambling funds, etc., and thus did not have any intent or ability to send the monitor to the victim.

The defendant deceivings the victim as above and acquired 2,80,000 won as the sales proceeds in the name of the defendant's agricultural bank account in the name of the defendant on the same day.

2. On March 18, 2018, the Defendant, at around March 18, 2018, posted a letter of sale of air air clean at the Defendant’s home located in Gwangju Northern-gu, to the Internet “China-gu” website, and reported it to the victim E who contacted, “the sales proceeds are paid.”
