A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Defendant is not a narcotics handler.

1. No person who violates the Narcotics Control Act shall cultivate plants used as raw materials for narcotics, or carry, possess, possess, control, export, import, give or receive, trade, or assist in the trade of, any raw materials, seed, or seedling containing their component, or extract therefrom;

Nevertheless, at around June 11, 2016, at the Defendant’s residence located in Cheongyang-gun E. 404, the Defendant: (a) placed 90 share of the nivers of narcotics collected by the Defendant in Cheongyang-gun, Chungcheongnam-gun, in a plastic beverage with approximately 3.6 liter capacity; and (b) made the nivers beverage with the nivers in approximately 3.6 liter capacity; (c) stored the nivers beverage made as above at the Defendant’s residence in the above nivers’ residence and possessed materials containing drug ingredients.
