Punishment of the crime

【Defendant B, along with L, set up a game product different from the game product rated under the name of another person on March 2013, 2013 and operated the game room. Defendant B, upon request by Defendant B and L on March 2013, ordered Defendant B to receive four million won from Defendant B and the above L to operate a general game providing business in his/her name, and allowed Defendant B and the above L to operate a game room. However, Defendant B and the above L were punished if the game room is controlled.

Defendant

B rather than having lent Defendant A’s name and received only KRW 4 million, Defendant B’s actual business owner who actively solicited Defendant B to open a game room and received 10% profit distribution. However, Defendant B paid money necessary for opening a game room, such as lease deposit (one right 89 pages of police investigation records of the case) while Defendant A paid money necessary for opening a game room (one right 2013Da1516). Defendant A did not have any money invested in the game room; Defendant B was an employee, and the former employee O was a “actual business,” and Defendant A was the head of A’s branch.
