Punishment of the crime

[Power of crime] The Defendant was sentenced to a suspended sentence of two years for special larceny, and imprisonment with prison labor for larceny on March 20, 2015; on June 19, 2015, the same court was sentenced to special larceny, six months of imprisonment with prison labor for fraud; and on September 16, 2015, the judgment became final and conclusive on September 16, 2015; and on September 9, 2016, the sentence of the suspended sentence was terminated.

[Criminal facts]

1. "2018 Highest 1876";

A. From around 05:50 on May 29, 2018, the Defendant: (a) opened a driver’s seat not corrected by the victim C, which was parked therein; and (b) took one copy of the Non-Correctioned Bank C, which was the victim’s possession of the victim’s C, and stolen it.

B. The Defendant violated the Act on Financial Business Specializing in Fraud and Credit, at around 06:02 on the same day, presented the e-mail card that was stolen as stated in paragraph (1) as if he was the Defendant’s card, and then had his nameless employees pay 10,000 won of the above PC, thereby having the Defendant pay PC amounting to 10,000 won, and then, from around that time to March 31 of the same month, used the stolen debit card amounting to 24 times as shown in attached Table 1, and acquired the total 36,600 won, and acquired the pecuniary benefits equivalent to 36,600 won.

2. On August 13, 2018, the Defendant: (a) laid down “H” on the second floor of the Seoyang-gu G building in Gyeyang-gu G at the Goyang-gu, Seoyang-gu, Seoyang-gu; (b) on August 13, 2018, the Defendant: (c) laid down one cell phone of the victim I, who is a customer, into the Defendant’s bar with his left hand and stolen it.
