Defendant
A shall be punished by imprisonment with prison labor for eight months and by imprisonment with prison labor for one year.
However, from the date this judgment became final and conclusive, Defendant.
Reasons
Punishment of the crime
[2015 Highest 3411] The Defendant is a person who operates the E gas station located in Spocheon-si D (Gu F gas station) together with B.
1. Violation of the petroleum and alternative fuel business Act;
A. At around 11:00 on December 30, 2014, the Defendant in collusion with B, etc., supplied fake petroleum products to H Co., Ltd., which was working at the said construction site at the price of KRW 2,159,820, by mixing them with carbon and hydrogen in light oil at the site of reconstruction construction in Mapo-gu Seoul Metropolitan Government, Mapo-gu. The Defendant sold fake petroleum products by selling 1,521 litres by mixing them with yellow salt so that they can be seen as light oil, and light oil can be seen as light oil.
B. On January 8, 2015, the Defendant, in collusion with B, etc., supplied fake petroleum products to H Co., Ltd., which had been working at the above construction site at the price of KRW 1,533,600, which combines carbon and hydrogen mixed with hydrogen in the light oil at the same place as above, and sold fake petroleum products at the price of KRW 1,080,000, which is 1,533,600.

At around 09:00 on January 26, 2015, the Defendant, in collusion with B, supplied 1,740 liters transit 1,740 liters, which combines carbon and hydrogen with oil in the same place as above, to H Co., Ltd. at the price of KRW 2,470,80,000, and sold fake petroleum products at the above construction site, at the price of KRW 2,470,80.
2. Attempted fraud;
A. On December 30, 2014, the Defendant conspired with B, etc. on December 11:0, 2014, at the site of the reconstruction construction project located in Mapo-gu Seoul Metropolitan Government, Mapo-gu, as described in paragraph (1)-A. The Defendant: (a) deceiving the victim as if he had sold 1,521 liter via a mix of carbon and hydrogen, which is mixed with hydrogen, to the victim H Co., Ltd; (b) by deceiving the victim as if he sold 1,521 liter via a mix of carbon and hydrogen; (c) filed a claim with the victim for KRW 2,159,820 under the pretext of the transit price; (d) however, the victim was found to have been guilty of the above oil and refused payment
