Punishment of the crime
[criminal power] On December 29, 1995, the Defendant was sentenced to six years of imprisonment with prison labor for larceny, etc. at the Daejeon District Court on February 6, 2004, eight months of imprisonment with prison labor for larceny at the Seoul Western District Court on July 20, 2007, four months of imprisonment with prison labor at the Seoul Western District Court on June 12, 2008, one year and six months of imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Larceny) at the Seoul Western District Court on June 4, 2010; two years of imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Larceny) at the Busan District Court on October 4, 2013; one year and six months of imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Larceny); and one year and six months of imprisonment with prison labor at the Seoul Western District Court on October 1, 2015.
【Criminal Facts】
1. Around January 15:16, 2019, the Defendant: (a) committed a theft of property worth KRW 1,350,000,000, total market price on five occasions, including that of 30,000,000, which was loaded in loading the victim’s cresh in front of Mapo-gu Seoul Metropolitan Government; and (b) 30,000,000, which was loaded in loading the victim’s cresh; and (c) by March 28, 2019, the Defendant stolen the boiler of KRW 1,350,00,000, total market price on five occasions, as written in the list of crimes.
2. On February 14, 2019, around 13:20 on the front day of Mapo-gu Seoul Metropolitan Government, the Defendant insultd the victim E (nive, 29 years of age) who walked along the paths among the 10 pedestrians, by citing tobacco as his/her hand, and made a horse dispute with the victim, and said, “ice flusium in the digging,” “gricker,” “gricker,” and “Iskaker,” thereby openly insulting the victim.
3. The Defendant for special assault was delivered before the restaurant of “G” located in Mapo-gu Seoul Metropolitan Government around 09:59 on March 11, 2019.
