The plaintiffs' lawsuit of this case is dismissed.

Costs of lawsuit shall be borne by the defendant.

Basic Facts

A. The Plaintiffs are members of the C Total Student Association (hereinafter referred to as the “Total Student Association”), and E, who were in office as the president of the 37 major Student Association, was replaced by the president of the 38 major Student Council on November 28, 2019 at the Standing Steering Committee of the 38 major Student Council.

B. E, as the president of the 37 major student council and the president of the Election Management Committee, publicly announced the candidate documents and registration schedule to elect the 38 major student president on three occasions on November 3, 2019, around November 13, 2019, and around November 17, 2019.

On November 22, 2019, the Election Management Committee of the Korean Federation of Students decided to transfer the agenda relating to the election of the 38th president of the Korean Federation to the Standing Committee, which is the highest voting body of the Korean Federation of Students, on November 22, 2019, because there is no possibility of candidate being elected within the registration period of candidate (from November 17, 2019 to November 25, 2019).

On November 28, 2019, the standing steering committee held a 4th temporary steering committee on November 28, 2019 and decided to substitute E with the chairperson of the 38th general student council with the consent of 19 members present, among 21 members present, while 21 members present, and on November 29, 2019, the chairperson of the 38th general student council and the chairperson of the 38th general student council at the time posted a letter that E was elected to the Internet camera of the 38 major student council.

E.
