A defendant shall be punished by imprisonment for two years.
Seized evidence Nos. 1, 2, and 3 shall be confiscated from the accused.
Reasons
Punishment of the crime
The Defendant was sentenced to imprisonment with prison labor for one year and six months in the High Court for the violation of the Narcotics Control Act on August 27, 2015 and completed the execution of the sentence at the Net Prison on November 15, 2016, and is not a narcotics handler.
1. On February 2, 2017, the Defendant, at the residence of D, in the middle of the following: (a) was dilutiond into water approximately 0.05 g (one philopon; hereinafter “philopon”); and (b) was administered in the form of injection using an injection device with the cropoper. 0.05 g; and (c) was administered in the form of injection with the cropoper.
2. On May 1, 2017, the Defendant purchased a philophone by taking out a philophone in the non-softel near G 1 G 22:00 on the second day of the second half of the day and around 0.3g of a philoopon from the non-softel near the opening area of the G 1 G 22:00 in order to purchase a philoopon in a way that he receives approximately KRW 1.50 thousand from a philoopon.
3. On May 31, 2017, at around 03:00, the Defendant administered approximately 0.05g of philopon, which was in possession of the Defendant under the same circumstance as paragraph 2, with J, at the domicile of the Defendant at around 03:00, in the same manner as Paragraph 1.
4. On May 31, 2017, at around 21:00, the Defendant administered approximately 0.05g of philopon, which was possessed with J, as well as around 0.05g of philopon, in the process of paragraph 2, in the middle-gu Incheon Metropolitan City, Jung-gu.
5. On June 1, 2017, the Defendant: (a) sold a philophone in the way of drying up one philophone, which was stopped in front of the dwelling place of L located in K, with the payment of KRW 500,000,000 from L, and approximately KRW 1g of a philophone.
6. On June 29, 2017, at around 14:30 on June 29, 2017, the Defendant purchased a part of a disposable injection device containing 0.5g (0.7g in the indictment, but the above correction is made) from N in Nam-gu Incheon Metropolitan City, and approximately 3.5g of a philopon.
7. On June 30, 2017, the Defendant stops at the same place as paragraph 5 at around June 30, 2017.
