A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
On June 26, 2019, the Defendant was sentenced to six months of imprisonment with prison labor for public performance and obscenity in Busan District Court on October 30, 2019, and completed the execution of the said sentence.
1. Embezzlements of lost possession;
A. On December 5, 2019, around 07:30 on December 5, 2019, the Defendant: (a) on the street club in front of the Busan Jin-gu, Busan; (b) on December 5, 2019, the victim’s name was lost; (c) on the part of the victim’s name was found to have been lost; and (d) on the part of the police, the Defendant did not take necessary procedures, such as reporting the loss to the police or returning the loss to the victim.
B. Accordingly, the defendant embezzled each of the assets that have been separated from the possession of the victims.
2. At around 08:46, December 9, 2019, the Defendant: (a) used the gravel subway station located in the Guro-gu, Busan, which had no legitimate right to use transportation cards for the elderly welfare of the elderly who acquired D as above; (b) used it to be provided with operational services for the subway amounting to KRW 1,300 from the victim Busan Urban Railroad; and (c) obtained financial benefits equivalent to the same amount from the victim by entering information processing systems, such as computers, etc. more than 53 times from that time until the 16th day of the same month, from that time, from the time to the point of entry in the list of crimes in the attached list of crimes.
