Reasons
Punishment of the crime
1. On February 15, 2016, the Defendant violated the Road Traffic Act employed D as an employee at a C cafeteria operated by the Defendant in Ansan-si, Seoul-si. Around 18:00.
An employer shall not prevent a driver who is prohibited from driving a motor, device, bicycle, etc. in accordance with the prohibition of driving, etc. without a license even though he/she knows that he/she drives a motor, device, bicycle, etc. or allow such driver to drive a motor, device
Nevertheless, on February 15, 2016, the Defendant had D, an employee, drive a FCA110 E-mail from around 22:30 on February 15, 2016 to the front road of Ansan-si E, Ansan-si without a motor device bicycle driver's license.
2. On February 16, 2016, the Defendant reported the receipt of a traffic accident on the following: (a) the Defendant called the victim’s Hyundai Commercial Reinsurance Co., Ltd. Customer Center’s name to an employee in the C cafeteria located in Ansan-si Member B; and (b) the Defendant caused a traffic accident that conflicts with the bus by sleeping the snow way while driving a FCA 110 E at the Dong-gu, Ansan-si, the Dong-gu, Ansan-si, an Osan-si; and (c) thereby, the Defendant reported the receipt of a traffic accident stating that “A Da Da 1401,00,000, Da 1410,000.”
However, the above traffic accident was caused by D without a motor device bicycle driver's license, and the defendant was well aware that he could not be subject to insurance in the event of an accident while driving by a person without a driver's license.
The Defendant, which caused the victim company to pay the H medical expenses of H hospital KRW 2,797,250 on March 22, 2016, and KRW 2,821,540 on March 31, 2016, by deceiving the victim company to pay KRW 2,821,540 on the pretext of insurance money.
3. On February 15, 2016, the Defendant was well aware that the Defendant was able to cause a traffic accident that conflicts with buses while driving FCA110E on the front road of Ansan-si, Ansan-si without a motor device bicycle driver’s license.
