Defendant shall be punished by a fine of two million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

1. 상표법위반 피고인은 2017. 6. 9. 13:45 경 서울 서초구 B에 있는 C 쇼핑몰 A012 'D‘ 매장에서 ’ 샤넬‘ 이 대한민국 특허청에 등록한 상표와 동일하거나 유사한 상표( 등록번호 400307170호 )를 부착한 팔찌 3점을 판매할 목적으로 소지한 것을 비롯하여 별지 범죄 일람표 (1) 기 재와 같이 위조 상표를 부착한 팔찌 10점을 판매할 목적으로 소 지하였다.

2. He/she shall not use another person's name, trade name, trademark, or container or package of goods, or any other mark identical or similar to another person's name, trade name, or one widely known in the Republic of Korea to violate the Unfair Competition Prevention and Trade Secret Protection Act, or sell, distribute, import, or export goods using such a mark to cause confusion with another person's goods;

그럼에도 피고인은 제 1 항 기재 일시, 장소에서 국내에서 널리 인식된 피해자의 등록 상표인 ‘ 꼼 데 가 르 송’( 등록번호 제 400597661) 과 동일하거나 유사한 표지를 부착 또는 도용한 팔지 2점 등 별지 범죄 일람표 (2) 기 재와 같이 팔 찌 8점을 전시하여 피해자의 상품과 혼동하게 하는 부정경쟁행위를 하였다.

3. Article 70 (1) and Article 69 (2) of the Criminal Act to attract a workhouse.

4. Article 236(1) of the Trademark Act that is confiscated, Article 48(1) of the Criminal Act

5. Article 334 (1) of the Criminal Procedure Act concerning the order of provisional payment;
