The defendant cooperates with the plaintiff in the procedure of changing the plaintiff's membership, which is based on the withdrawal of the defendant.
Reasons
The facts that the Defendant joined and held office as a member of the Plaintiff on May 7, 2014, and submitted an application for the withdrawal from membership to the Plaintiff on March 24, 2015 can be acknowledged either as a dispute between the parties or as a whole by considering the purport of the entire pleadings in the evidence Nos. 1 and 2.
Article 46 (1) and Article 46 (1) of the Attorney-at-Law Act (Secession of Members) (1) A member may withdraw at will.
In light of the foregoing, a partner of a law firm may withdraw at a free will, and the withdrawal becomes effective as the declaration of intention to withdraw reaches the law firm. Therefore, it shall be deemed that the effect of withdrawal on March 24, 2015, which the defendant submitted to the plaintiff the application for withdrawal of a partner, expressed his/her intention to withdraw.
Meanwhile, Article 43 (1) and Article 43 (2) 2 of the Attorney-at-Law Act (Registration) (1) of the Attorney-at-Law Act must be registered within two weeks after obtaining authorization for establishment.
The same shall also apply to any change in the registered matters.
(2) Matters to be registered under paragraph (1) shall be as follows:
2. In full view of the name and resident registration number of partners and the address of a partner who represents the law firm, the law firm must register the change following the withdrawal of partners. Thus, the withdrawn defendant is obligated to cooperate with the procedures for the registration of change of a partner.
Article 11 (4) and Article 11 (Registration of Law Firm) (4) of the Enforcement Decree of the Attorney-at-Law Act (Registration of Law Firm) shall apply mutatis mutandis to the registration of law firm, except as otherwise provided for in the Act and this Decree.
Article 23 (1) and 23 (1) of the Commercial Registration Act (1) of the Commercial Registration Act shall apply for registration of a company by its representative, unless otherwise provided for in Acts.
In full view of the above, the registration of the law firm shall be filed by the representative of the law firm independently, so the registration procedure for the alteration shall be applied to the defendant who has withdrawn from the plaintiff.
