Defendant shall be punished by imprisonment for a term of one year and two months.
Reasons
. The date and time set forth in the above paragraph (a) and at the same time, send the forged application to the person in charge of KT, who is an agency of opening mobile phones, who is aware of the forgery, by facsimile, as if the three copies of the forged application were the document duly drawn up.
When the Defendant, “2014 Highest 7707,” was aware of the fact that a person who operates a mobile phone agency with the trade name “D” in Incheon City’s Gu C, and that customers may receive approximately KRW 100,000 from the said agency, he/she was willing to open the mobile phone at his/her own discretion by using personal information of customers who open the mobile phone.
1. Around July 16, 2013, the Defendant forged a private document stating the name of the customer and the applicant column as “U” by using a black pen on the “application form for Maleh Mobmble” kept at the foregoing agency. On the resident registration number column, the Defendant signed U’s signature in the signature column, stating “V” and “In Incheon, Seo-gu W apartment**********.” in the resident registration number column and the address column.
Accordingly, for the purpose of uttering, the Defendant forged one copy of the “application for Mambromo” in U’s name, a private document relating to rights and obligations.
2. The Defendant sent a forged application form to the person in charge of KTM&S, who is an agent of a mobile phone, who is aware of the forgery at the above time and at the above place, by facsimile, as if the application form for forgery was a document duly prepared.
The Defendant is a person who worked from a “D” sales store located in Bupyeong-gu Incheon, Bupyeong-gu, Incheon to be an employee.
1. Forgery of private documents;
A. On May 13, 2013, the Defendant, without authority, uses a pen to “Y” in the customer name column, “Y” in the resident registration number column, “Z” in the address column, “AB” in the entry desire number column, and “AB” in the application date column, and “Emb” in the application date column.
