The defendant shall be innocent.

1. On June 10, 2013, the Defendant entered into a sales contract with a view to purchasing KRW 5 million with respect to a distribution field owned by D and an agricultural product cultivated by D (referring to a unit of a vinyl, which is a contract area, a math dry field) in the Gangwon-gu Military Branch C, and drafted a standard contract for the distribution of agricultural products (hereinafter “sales contract”).

On June 11, 2013, the Defendant issued a sales contract to D, stating that “I wish to give money in front of the F Pharmacy in Gangwon-gun E, Gangwon-gu, the Defendant changed the number of “1” in front of the contractual area column and delivered to D, after having received the sales contract from D, to “I will change the date of the contract with which I will give money to increase the amount of money.”

Accordingly, the defendant modified the sales contract in the name of D, a private document concerning rights and obligations without authority for the purpose of exercising the right.

2. Determination

A. (1) On June 10, 2013, the Defendant entered into a sales contract with respect to the distribution of land D and Gangwon-gun C by introducing G on June 10, 2013, and entered into a sales contract with “8 miles” and “five million won” as the purchase price. On June 11, 2013, the Defendant remitted KRW 5 million to the head of Tong in the name of H.

(2) In the seller column of a sales contract held D, “D”, “the Defendant”, “the item column in the item column, “5,00,000 won”, “5,000 won” in the total sale price column, “the deposit amount in full on June 10, 2013”, and “CFIH” in the contract date column, and the contract area column is reduced to the part indicated “18 E” in the contract area column, and above. Meanwhile, the sales contract held by the Defendant is limited to the location of “8 E” in the part indicated in the sales contract in possession of D.
