A defendant shall be punished by imprisonment for two years.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant: (a) lent 15 years old to the victim B (Nam, and 15 years old) of Grade III intellectual disability; (b) had the victim paid 10 years old; and (c) had the victim paid 10 years old since 15 years old, the Defendant had the victim feel 10 years old without any trouble; and (d) had the victim fright as if the 3rd party caused the 10th anniversary of the 3rd party’s trouble, and had the victim fright

피고인은 2018. 10. 9. 19:00경 대구 달성군 C에 있는 ‘D초등학교’ 운동장에서, 피해자에게 시간당 1,000원을 받고 오토바이를 빌려준 다음 피해자가 오토바이를 타다가 돌아오자, 마치 피해자가 오토바이를 타다가 오토바이를 고장 낸 것처럼 행세하며 피해자에게 “니가 오토바이를 타서 엔진소리가 이상하고 오토바이가 망가졌다, 수리비로 160만 원을 받아야하는데 10만 원을 깎아 줄테니 11월말까지 150만 원을 가지고 와라, 돈을 주지 않으면 너희 집에 찾아가서 다 부숴버리겠다, 아르바이트를 하든지 절도를 하든지 돈을 가지고 와라”고 겁을 주어 피해자로부터 금품을 갈취하려 하였으나, 피해자가 같은 날 21:30경 아파트 3층 복도 난간에 걸터앉아 자살시도를 하다가 떨어져 크게 다치는 바람에 그 뜻을 이루지 못하고 미수에 그쳤다.
