Punishment of the crime

The defendant is the representative director of the Guro-gu Seoul Metropolitan Government F building and H Co., Ltd. who runs the electricity and telecommunications business with 20 full-time workers.

1. When a worker dies or retires, the employer shall pay the wages, compensations, and other money or valuables within fourteen days after the cause for such payment occurred;

Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.

The Defendant is working from October 19, 2015 to August 16, 2017 at the construction site located in YI in Masung-si.

The bill of indictment in 2017 of the J's 2017 is "2016", but it is obvious that it is a clerical error in the "2017" on the record.

8. The amount of 1,809,677 won paid in August is not paid within 14 days from the date of retirement without agreement between the parties to the extension of the due date, and as shown in Section 1 of the Attached List of Crimes, the term "2016" in the corresponding part of the Attached List of Crimes is a clerical error of "2017."

As set out in Nos. 1 through 4, 6, the total wage of 10,725,677 for 5 workers was not paid within 14 days from the date of retirement without an agreement between the parties to the extension of the payment date.

2. When a worker retires, the employer shall pay the retirement allowance within fourteen days after the cause for such payment occurred; and

Provided, That the date of payment may be extended by an agreement between the parties in extenuating circumstances.

The Defendant is working from October 19, 2015 to August 16, 2017 at the construction site above and from October 19, 2015.

The retirement allowance of retired workers J was not paid KRW 6,212,061 within 14 days from the date of retirement without any agreement between the parties on the extension of the due date.
