Defendant shall be punished by a fine of KRW 3,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The defendant is the representative director of the D Co., Ltd. located in the Songpa-gu Seoul Metropolitan Government B building C, who is the representative of H diving store located in the Songpa-gu Seoul E-G and runs a sports business with 100 full-time workers.

1. When a worker dies or retires, the employer shall pay the wages, compensations, and other money or valuables within 14 days after the cause for such payment occurred;

Nevertheless, the Defendant, at the place of business of H diving Co., Ltd., the said Defendant works from April 28, 2014 to January 31, 2018.

A retired worker I’s wages of 3,895,850 won in September 2017, wages of 1,260,370 won in October 2017, wage of 2,94,880 won in December 2, 2017, wage of 4,825,030 won in January 2018, other allowances of 982,830 won in the year-end tax settlement in January 2017, and other allowances of 982,830 won in the place of business of the said stock company D, from August 8, 2016 to January 12, 2018.

A retired worker J’s wages of 1,033,333 won in October 2017, wages of 1,936,666 won in December 2017, and wages of 968,917 in January 2018, did not pay 17,847,876 won in total within 14 days from the date of retirement without any agreement on extension of the due date between the parties.

2. When a worker retires, the employer shall pay the retirement allowance within fourteen days after the cause for such payment occurred.

Nevertheless, the Defendant, at the place of business of H diving Co., Ltd., the said Defendant is working from April 28, 2014 to January 31, 2018.

Retirement allowance of retired workers I 10,915,570 won, and the workplace of the said D Co., Ltd. from August 8, 2016 to January 12, 2018.

The retirement allowance of retired workers J did not pay the total of 13,707,917 won within 14 days from the date of retirement without any agreement between the parties on extension of the due date.
