1. Defendant B Co., Ltd. shall pay to the Plaintiff KRW 728,094,531 as well as its annual interest from November 23, 2017 to November 25, 2020.
Reasons
1. Basic facts
A. The Plaintiff is a company established on February 14, 2017 and engaged in reinforced concrete construction business, civil engineering business, construction business, etc., and Defendant B Co., Ltd. (former trade name: G Co., Ltd.; hereinafter “Defendant Company”), regardless of whether it was before or after the mutual change.
(2) Defendant C is the representative director of the Defendant Company, and Defendant D and E is a former inside director of the Defendant Company.
B. The Defendants’ land purchase and sale and construction permission, etc. 1) Defendant Company is the Defendant FIC (hereinafter “Defendant church”) on August 24, 2013.
(2) On October 27, 2014, the Defendant church purchased KRW 33,058 square meters of land in the wife population H 33,058, and concluded a sales contract with the purport that the remaining KRW 14,60,000,000 shall be paid at the time of conclusion of the contract, and the remaining KRW 2.66,00,000,000 was to be paid within 15 days after the completion of the entire authorization and permission and the performance of the civil works. (2) The land in the wife population H 33,058 square meters of land in the wife population at Chicago-si on October 27, 2014 was subject to registration conversion with KRW 33,426 square meters of land in the wife population at Chicago-si, and on January 28, 2015, the land in question was divided into the land in question as the “land in question”).
3) Around March 2015 and around June 2015, Defendant church completed the registration of ownership transfer with respect to part of the instant land as indicated below with respect to Defendant Company and Defendant C, and D, and Defendant E around August 2016. The Defendant church obtained permission to engage in the development activities with respect to the instant land, for which Defendant D and D obtained permission to engage in the development activities with respect to the following land (hereinafter “Defendant D and D”) for the purpose of obtaining permission to engage in the development activities around 12,311 square meters of shares in the lot number ownership, 12,307.7/12311, Defendant E-3/12311 J. 3/19,819 square meters of Defendant church 19,3/19819, Defendant D3/19, Defendant D3/19819, Defendant E-3/19819, Defendant E-3/19, 1981 K.1, 296 square meters of the instant land.
